Swage — Terms of Use

These terms govern your use of Swage (swage.app), operated by B&M Bodyworks PTY LTD ("we", "us", "B&M").

By creating an account or using Swage, you agree to these terms. If you are using Swage for a business, you confirm you are authorised to accept these terms on its behalf.

Definitions

• Estimate — an indicative repair cost range generated by Swage from information you enter.
• Firm Quote — a written, fixed price issued by B&M following physical inspection of a vehicle.
• You — the account holder and the business they represent.

Swage produces an indicative estimate of body repair costs from the vehicle details, damage panels and severity levels you enter, or from photographs you upload.

Swage is an information tool to support your own commercial judgement. It is not an inspection, a valuation, a mechanical report, or professional advice.

An Estimate is indicative only. It is not an offer, a quote, or a commitment by B&M to perform work at that price, and it is not capable of acceptance.

An Estimate:

• is generated automatically from the information entered, without any person inspecting the vehicle;
• prices visible damage only — it cannot account for structural, mechanical, electrical, sensor or concealed damage;
• is based on typical panel sizes and standard repair methods, which vary between vehicles;
• may be higher or lower than the actual cost of repair.

Neither party is bound by an Estimate. B&M is under no obligation to carry out any repair at or near an estimated figure, and you are under no obligation to have any work performed by B&M.

A Firm Quote is issued in writing by B&M after we have physically inspected the vehicle, and is a fixed price for the scope of work described in it.

A Firm Quote:

• is valid for 30 days from the date of issue;
• covers only the work expressly described in it;
• is subject to parts availability and to the vehicle being presented in the condition inspected.

Where additional damage is discovered on disassembly that was not reasonably identifiable at inspection, we will provide a supplementary quote for that additional work and will not proceed with it without your approval.

Where a Firm Quote is accepted, the terms of that quote govern the repair work, not these terms.

Swage is used at the point of a purchasing decision. You acknowledge and agree that:

• You are solely responsible for your own purchasing, bidding and valuation decisions. Swage informs them; it does not make them.
• We are not responsible for any decision you make in reliance on an Estimate — including bidding on a vehicle, declining to bid, the price you bid, or any vehicle you buy or do not buy.
• We are not responsible for a purchase opportunity you miss, or for any difference between an Estimate and the actual cost of repairing a vehicle.
• Where an Estimate raises a flag — structural damage, sensor or ADAS involvement, or a recommendation to inspect — you should obtain a physical inspection before committing.

You should satisfy yourself as to the condition of any vehicle by your own inspection and enquiries.

We build Swage on real repair costings and work to keep it accurate, but we do not warrant that any Estimate will be accurate, complete, or suitable for a particular vehicle or purpose.

Estimates depend on the information you enter. Incorrect vehicle details, mis-marked panels or unclear photographs will produce an unreliable figure.

Where Swage uses automated image analysis to identify damage, that analysis is indicative and requires your review. You are responsible for confirming the damage marked before relying on the result.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that paragraph, and to the extent permitted by law:

(a) We are not liable for any indirect or consequential loss, or for loss of profit, loss of opportunity, loss of anticipated savings, or loss of business, arising from your use of Swage or reliance on an Estimate.

(b) Where our liability can be limited rather than excluded, our liability for any claim relating to Swage is limited, at our option, to resupplying the service or paying the cost of resupply.

(c) Our liability is reduced to the extent your own acts or omissions caused or contributed to the loss.

Where access is provided on a trial basis:

• access is provided free of charge and may be varied, suspended or withdrawn at any time;
• Swage is provided as-is, and may contain incomplete pricing data or features still in development;
• some part prices are confirmed and others estimated. Where the platform indicates a line is estimated, it should be treated with additional caution;
• you agree we may contact you for feedback, and may use that feedback to improve the platform without obligation to you.

• Keep your login credentials secure and do not share them outside your business.
• You are responsible for activity under your account.
• Tell us promptly if you believe your account has been accessed by someone else.
• We may suspend or terminate access where these terms are breached, or where the platform is used in a way that damages B&M's business or reputation.

Estimates you create are visible to your account and to B&M as operator of the platform.

We use the data generated through Swage — including vehicle details, damage recorded, and repair outcomes — to operate and improve the platform, including improving pricing accuracy. We do not sell your data or disclose your individual estimates to other dealers.

Our handling of personal information is governed by our Privacy Policy.

Swage, including its pricing models, rules, data compilations, interface and branding, is owned by B&M. Your access does not transfer any ownership.

You must not copy, reverse engineer, resell or make Swage available to third parties, or use it to build a competing product. You must not use automated means to extract pricing data from the platform.

We may change these terms from time to time. We will give reasonable notice of material changes. Continuing to use Swage after that means you accept the updated terms.

• These terms are governed by the laws of Queensland, and the parties submit to the non-exclusive jurisdiction of the courts of that state.
• If any provision is found unenforceable, it is severed and the rest continues to apply.
• These terms are the entire agreement between us in relation to Swage.
